The Resources are provided with all faults and the entire risk as to their satisfactory quality, performance, accuracy and effort remains with the user.
The enLearned LLC Parties do not warrant that the Resources will meet your specific purposes or needs, or that the operation or use of the Resources will be uninterrupted or error-free. The enLearned LLC Parties disclaim any and all implied liability for any damages resulting from the provision of the Resources pursuant to this User Agreement, including, without limitation, any errors, omissions, interruptions, delays, unlawful conduct, mistakes, misrepresentations or other defect resulting from the lack of supply of resources, either by action or omission, or by other damages produced.
Limitation of Liability
In connection with the limitation of warranties set forth above, you expressly understand and agree that your possible recovery for any claim against the enLearned LLC parties arising out of or relating to the Resources or this User Agreement will be limited to the amount, if applicable, paid by you , for the use of products and/or services. enLearned LLC Parties shall not be liable for any direct, indirect, incidental, consequential or exemplary loss or damage you may suffer as a result of your use of the Resources or as a result of any modification, loss or corruption of data or cancellation, loss of access or downtime.
Copyright, trademark and license
Subject to your compliance with this User Agreement, the enLearned LLC Parties grant you a non-exclusive, non-sublicensable, revocable, non-transferable license to access the Boater's Academy websites and use the Resources as set forth in this User Agreement. The Resources, including any portion of the Boater's Academy websites, may not be reproduced, duplicated, copied, modified, sold, resold, distributed, transmitted or otherwise exploited for any commercial purpose without the prior written consent of the enLearned LLC parties. All rights not expressly granted in this User Agreement are reserved by the enLearned LLC parties. Your rights under this section will immediately terminate if, in the sole discretion of the enLearned LLC parties, you violate or potentially violate any term of this User Agreement.
termination of use
You agree that we may, in our sole discretion, suspend or terminate your access to all or part of our website and resources, with or without notice and for any reason, including, without limitation, your breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship with Boater's Academy and may be referred to the appropriate law enforcement agencies. Upon suspension or termination, your right to use the Resources we provide will immediately cease and we reserve the right to delete or delete any information you have stored with us, including any account or login information.

You consent to personal jurisdiction in such courts and waive any objections to jurisdiction, venue or inconvenient place in such courts.
You agree that any claim you bring against any party of enLearned LLC will be asserted solely in your individual capacity and not as a plaintiff or class member in any intended class or representative action.
If any enLearned LLC party brings a claim against you arising out of or relating to the Resources or this User Agreement, the enLearned LLC parties shall be entitled to recover reasonable costs and attorneys' fees incurred as a result of such claim. from you. If you make a claim against any party of enLearned LLC arising out of or relating to the Resources or this User Agreement, and any party of enLearned LLC prevails over that claim, the parties of enLearned LLC shall be entitled to recover their reasonable costs reimbursed by you and attorneys' fees incurred as a result of such claim.
REFUND POLICY
Refunds will only be given if, through no fault of your own (i.e., due to an outage or other lack of functionality of the Boater's Academy websites), during a period of forty-eight (48) hours from the time you register and pay to access the resources. Once you receive a certificate of completion, no refunds will be given.
